1. Acceptance of terms

By accessing or using the Second Cure platform, website, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services.

These Terms constitute a legally binding agreement between you and Second Cure Labs Ltd ("Second Cure", "we", "us", "our"), a company registered in Lagos, Nigeria.

2. Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Be a resident of Nigeria or currently located in Nigeria
• Be capable of forming a legally binding contract
• Provide truthful, accurate, and complete information during your assessment
• Not have any medical contraindications that preclude the use of Tirzepatide, as determined during our review process

By creating an account, you represent and warrant that you meet all eligibility requirements.

3. Description of services

Second Cure provides a digital platform for Tirzepatide assessment, ordering, delivery coordination, and support for the purpose of:

• Assessment for eligibility for Tirzepatide weight treatment
• Tirzepatide ordering, fulfilment, and dose progression guidance
• Ongoing treatment support, check-ins, and order management
• Cold-chain medication delivery to your specified address
• Patient support via your account and shared support channels

Our Services are not a substitute for emergency medical care. If you are experiencing a medical emergency, call 112 or go to your nearest hospital immediately.

4. Medical disclaimers

Treatment approval is not automatic. Second Cure provides the platform, ordering flow, and operational infrastructure. Eligibility, dose progression, and order approval are determined during our review process before treatment moves forward.

No guaranteed outcomes. Weight loss results vary between individuals. The clinical data and projections provided on our platform are based on published clinical trial results and are not guarantees of individual outcomes.

Side effects. GLP-1 medications may cause side effects. Common side effects include nausea, reduced appetite, and gastrointestinal discomfort. Serious side effects, while rare, may include pancreatitis and allergic reactions. Full safety information is available on our Safety page.

Accurate information. You are responsible for providing accurate and complete health information during your assessment. Providing false or misleading information may result in inappropriate treatment and could endanger your health.

5. Account and security

You are responsible for maintaining the confidentiality of your account credentials. If you suspect unauthorised access to your account, use the support channel shared in your account or order communications as soon as possible.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

6. Payment terms

• Pricing: Current pricing is published on our Pricing page. Prices are quoted in Nigerian Naira (NGN) and include medication, assessment review, cold-chain delivery, and support.
• Payment: Payment is due before each monthly medication shipment. We accept bank transfers, debit cards (Visa, Mastercard, Verve), and mobile payments via Paystack.
• Price changes: We may adjust pricing with 30 days' written notice. Existing subscriptions will honour the quoted price for the current billing cycle.
• Taxes: All prices are inclusive of applicable VAT where required by Nigerian tax law.

7. Subscription and cancellation

• Monthly billing: Your treatment operates on a monthly billing cycle. There are no long-term contracts.
• Cancellation: You may cancel your treatment at any time by contacting our support team at least 7 days before your next billing date.
• Pausing treatment: You may request to pause your treatment for up to 60 days. Resumed treatment may require a fresh assessment.
• Refunds: If your order does not move forward after assessment, you will receive a full refund. Once medication has been prepared and shipped, refunds are not available due to cold-chain handling requirements.

8. Delivery

• Medications are delivered via cold-chain logistics to the address you provide during your assessment.
• You must be available to receive delivery or designate a responsible adult to accept on your behalf.
• Delivery timelines are estimates. Standard delivery is 3–5 business days from prescription approval. We are not liable for delays caused by logistics providers, weather events, or incorrect addresses.
• You must store medications according to the instructions provided (typically refrigerated at 2–8°C). Second Cure is not responsible for medication that is improperly stored after delivery.

9. Intellectual property

All content on the Second Cure platform, including text, graphics, logos, images, software, and the overall design, is the intellectual property of Second Cure Labs Ltd and is protected by Nigerian copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works from any part of our platform without our express written permission.

10. User conduct

You agree not to:

• Provide false or misleading health information
• Share, sell, or transfer your prescribed medication to any other person
• Use the platform for any unlawful purpose
• Attempt to access other users' accounts or data
• Interfere with the operation of the platform
• Use automated tools to scrape or access the platform

11. Limitation of liability

To the maximum extent permitted by Nigerian law:

• Second Cure Labs Ltd shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
• Our total liability for any claim arising from the Services shall not exceed the amount you paid to us in the 3 months preceding the claim.
• We are not liable for adverse health outcomes resulting from your failure to disclose relevant medical information, failure to follow clinical instructions, or improper medication storage.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by Nigerian law.

12. Indemnification

You agree to indemnify and hold harmless Second Cure Labs Ltd, its directors, employees, and agents from any claims, losses, or damages arising from your breach of these Terms, your misuse of the Services, or your provision of inaccurate information.

13. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal and health data in compliance with the Nigeria Data Protection Commission (NDPC) framework.

14. Modifications to terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the platform at least 14 days before they take effect. Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms.

15. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

Any disputes arising from these Terms or the Services shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to mediation, and if mediation fails, to the courts of Lagos State, Nigeria, which shall have exclusive jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
